Notice to Shippers & Consignees: These Terms of Use govern your access to and use of the Ship2Pi online box tracking portal, account management, and notification services provided by Ship2Pi LLC ("Ship2Pi", "we", "us"). By creating an account, setting a password, or using this platform, you agree to these Terms.

1. Software Platform Only (We Do Not Touch Your Cargo)

Ship2Pi LLC is exclusively a software and technology provider. Ship2Pi LLC is NOT a freight forwarder, motor carrier, ocean carrier, cargo bailee, customs broker, or warehouseman.

Ship2Pi LLC does not pack, pick up, weigh, inspect, store, clear customs, transport, or deliver any balikbayan boxes, packages, or property. All physical shipping, handling, home pickup routes, container transport, and delivery operations are conducted entirely and independently by the local logistics company ("Agent") identified on your account or receipt.

2. Sole Recourse Against Your Shipping Agent (No Action Against Ship2Pi LLC)

YOU EXPRESSLY COVENANT AND AGREE THAT ANY QUESTIONS, DISPUTES, INSURANCE CLAIMS, REFUND REQUESTS, OR LEGAL CLAIMS CONCERNING:

  1. Lost, damaged, stolen, destroyed, delayed, or customs-confiscated boxes or cargo contents;
  2. Pickup scheduling, driver punctuality, pricing, payments, or physical handling;
  3. Customs duties, taxes, regulatory inspections, or Philippine customs clearance delays; or
  4. Any conduct, acts, or omissions of your local forwarder or their representatives;

MUST BE DIRECTED AND BROUGHT SOLELY AND EXCLUSIVELY AGAINST YOUR INDEPENDENT SHIPPING AGENT. YOU EXPRESSLY COVENANT NOT TO SUE, PURSUE REMEDIATION, OR INITIATE LEGAL CLAIMS AGAINST SHIP2PI LLC OR ITS PEOPLE FOR ANY SUCH MATTERS.

3. Release and Hold Harmless

You hereby release, waive, acquit, and forever hold harmless Ship2Pi LLC, its owners, officers, members, employees, and software providers from any and all liability, claims, causes of action, damages, or costs arising out of or related to the transportation, handling, delivery, or tracking of your cargo, or your interaction with any independent Agent.

4. Total Limitation of Liability ($0.00 Cap)

Ship2Pi LLC provides this tracking software service to you free of charge. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHIP2PI LLC'S AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF YOUR USE OF THE SOFTWARE EXCEED ZERO DOLLARS ($0.00), OR THE TOTAL FEES YOU ACTUALLY PAID TO SHIP2PI LLC IN THE LAST 30 DAYS (WHICHEVER IS LESS).

5. Express Consent for Transactional SMS & Email Notifications

By providing your telephone number and email address, creating an account, or claiming a profile with a password, you grant express electronic consent to receive automated transactional notifications regarding the status, transit, location, and delivery of your balikbayan boxes via SMS text messages and email.

  • These messages are strictly transactional and related to your cargo tracking.
  • Message frequency varies based on container and box transit milestones. Standard message and data rates may apply.
  • You may revoke SMS consent at any time by texting STOP in reply to any text notification received.

6. Class Action Waiver & Individual Dispute Resolution

You agree that any dispute or claim against Ship2Pi LLC shall be resolved exclusively on an individual basis via binding arbitration, and you expressly waive any right to bring or participate in any class action, collective lawsuit, or representative proceeding.
